رفض تصريحات التهجير القسري ودعوة للمجتمع الدولي لاتخاذ موقف حازم
تعرب الشبكة العربية للمؤسسات الوطنية لحقوق الإنسان عن إدانتها الشديدة ورفضها القاطع لتصريحات الرئيس الأمريكي دونالد ترامب، التي تدعو إلى التهجير القسري للشعب الفلسطيني إلى مصر والأردن وأماكن أخرى، معتبرةً هذه التصريحات انتهاكًا صارخًا للقانون الدولي ومحاولة مفضوحة لتصفية القضية الفلسطينية، في ظل استمرار الجرائم الإسرائيلية الممنهجة بحق المدنيين الفلسطينيين في قطاع غزة والضفة الغربية.
وتشكل هذه التصريحات سابقة خطيرة في الاستخفاف بالقانون الدولي وازدرائه وتقويض فعاليته والثقة به، إذ تشرعن التطهير العرقي وتمنح الجرائم الإسرائيلية غطاءً سياسيًا ودعائيًا لاستمرار العنصرية الإسرائيلية، وتؤجج خطاب الكراهية ضد الفلسطينيين، مما يعزز الدعوات إلى طردهم وتهجيرهم القسري.
تؤكد الشبكة أن هذه التصريحات تمثل تراجعًا خطيرًا عن الالتزامات الدولية تجاه حقوق الشعب الفلسطيني، لا سيما حقه في تقرير المصير والعودة. كما أنها تشكل انتكاسة خطيرة لجهود تحقيق السلام العادل في الشرق الأوسط، وتكرّس الانحياز الأمريكي المطلق للاحتلال، في مخالفة واضحة للقرارات الأممية والقانون الدولي الإنساني، بما في ذلك اتفاقيات جنيف وميثاق الأمم المتحدة.
تعتبر الشبكة أن هذا الموقف يأتي في سياق أكثر من عامٍ من المجازر المتواصلة التي ترتكبها قوات الاحتلال الإسرائيلي، وتشمل الإبادة الجماعية، والتهجير القسري، والحصار والتجويع الممنهج، إضافة إلى استهداف المرضى والطواقم الطبية، في انتهاك واضح لكل القوانين والمواثيق الدولية.
ترفض الشبكة بشدة أي محاولات للتضليل أو التلاعب بالمصطلحات لتبرير التهجير القسري للشعب الفلسطيني، بما في ذلك محاولات تسميته زورًا بـ "الهجرة الطوعية"، في حين أنه تهجير قسري يقوم على الهندسة العرقية، ويتم فرضه من خلال التجويع الممنهج، والتدمير المتعمد للبنية التحتية، ومنع جهود الإعمار في قطاع غزة، وهي سياسات تنفذها قوات الاحتلال الإسرائيلي بهدف فرض واقع لا يُطاق على الفلسطينيين وإجبارهم على مغادرة أرضهم قسرًا.
تشدد الشبكة على أهمية تفعيل آليات القانون الدولي لحقوق الإنسان، والقانون الدولي الإنساني، والقانون الجنائي الدولي، لضمان محاسبة الاحتلال الإسرائيلي وقادته على الجرائم التي اقترفوها بحق الشعب الفلسطيني، ومن بينها جرائم الإبادة الجماعية، التهجير القسري، وجرائم الحرب والجرائم ضد الإنسانية.
إنَّ الحل العادل للقضية الفلسطينية لن يتحقق إلا من خلال تنفيذ قرارات الأمم المتحدة ذات الصلة، وفي مقدمتها قرار الجمعية العامة رقم 194 (1948) الذي يؤكد حق اللاجئين الفلسطينيين في العودة والتعويض، وقرار مجلس الأمن رقم 242 (1967) الداعي إلى انسحاب إسرائيل من الأراضي المحتلة عام 1967، وقرار 338 (1973)، وقرار 478 (1980) الذي يعتبر ضم إسرائيل للقدس الشرقية غير شرعي، إضافة إلى قرار 2334 (2016) الذي يدين الاستيطان الإسرائيلي في الأراضي الفلسطينية المحتلة، إلى جانب الرأي الاستشاري لمحكمة العدل الدولية الذي أكد عدم شرعية الاحتلال الإسرائيلي وضرورة إنهائه في أسرع وقت، وقرار الجمعية العامة للأمم المتحدة الصادر في سبتمبر 2024 الذي يدعو إلى إنهاء الاحتلال الإسرائيلي خلال عام.
تدعو الشبكة إلى الالتزام بقرارات محكمة العدل الدولية والمحكمة الجنائية الدولية، باعتبارها مرجعيات قانونية حاسمة تعكس الإرادة الدولية في تحقيق العدالة وإنهاء الاحتلال.
تثمّن الشبكة المواقف الواضحة والحازمة التي اتخذتها العديد من الدول في مختلف أنحاء العالم، ومواقف الدول العربية، وفي مقدمتها مصر والأردن ودولة فلسطين، التي أكدت رفضها القاطع لأي محاولات تهدف إلى تصفية القضية الفلسطينية أو المساس بحقوق الشعب الفلسطيني. وترى الشبكة أن هذه التصريحات تشكل تهديدًا مباشرًا للأمن القومي العربي، إضافة إلى كونها انتهاكًا صارخًا لمبادئ القانون الدولي وقرارات الشرعية الدولية.
تطالب الشبكة الأمم المتحدة والمجتمع الدولي باتخاذ موقف حازم إزاء هذه التصريحات الخطيرة، من خلال:

Rejecting statements on forced displacement and calling on the international community to take a firm stance
The Arab Network of National Human Rights Institutions (ANNHRI) expresses its strong condemnation and categorical rejection of the statements of US President Donald Trump, calling for the forced displacement of the Palestinian people to Egypt, Jordan, and other places. ANNHRI considers these statements a flagrant violation of international law and a blatant attempt to liquidate the Palestinian cause, in light of the ongoing systematic Israeli crimes against Palestinian civilians in the Gaza Strip and the West Bank.
These statements constitute a dangerous precedent in disregarding and showing contempt for international law, undermining its effectiveness and credibility. They legitimize ethnic cleansing, provide political and propaganda cover for the continuation of Israeli crimes, and fuel the discourse of racism and hatred against Palestinians, reinforcing Israeli calls for their expulsion and forced displacement.
ANNHRI affirms that these statements represent a serious retreat from international obligations regarding the rights of the Palestinian people, particularly their right to self-determination and return. It also constitutes a significant setback to efforts to achieve a just peace in the Middle East, further entrenching absolute American bias toward the Israeli occupation, in clear violation of international resolutions and international humanitarian law, including the Geneva Conventions and the UN Charter.
The Network considers that this stance comes amid more than a year of ongoing massacres committed by Israeli occupation forces, including genocide, forced displacement, siege, and systematic starvation. Additionally, it includes targeting patients and medical staff in clear violation of all international laws and conventions.
ANNHRI strongly rejects any attempts to mislead or manipulate terminology to justify the forced displacement of the Palestinian people, including attempts to falsely label it as "voluntary migration." The reality is that this displacement is forced, based on ethnic engineering, imposed through systematic starvation, deliberate destruction of infrastructure, and obstruction of reconstruction efforts in the Gaza Strip. These policies, implemented by Israeli occupation forces, aim to impose an unbearable reality on Palestinians and force them to leave their land.
ANNHRI stresses the importance of activating mechanisms of international human rights law, international humanitarian law, and international criminal law to ensure that Israeli occupation leaders are held accountable for their crimes against the Palestinian people, including genocide, forced displacement, war crimes, and crimes against humanity.
A just solution to the Palestinian issue can only be achieved through the implementation of relevant United Nations resolutions, including:
ANNHRI urges adherence to the rulings of the International Court of Justice (ICJ) and the International Criminal Court (ICC), as they serve as decisive legal references reflecting international will to achieve justice and end the occupation.
The Network appreciates the clear and firm positions taken by many countries worldwide, particularly those of Egypt, Jordan, and the State of Palestine, which have strongly rejected any attempts to liquidate the Palestinian cause or undermine Palestinian rights. ANNHRI views Trump’s statements as a direct threat to Arab national security and a flagrant violation of international law and UN resolutions.
